Participant Waiver and Release of Liability
At Boston Private Guide, your safety and enjoyment are our highest priorities. By participating in one of our tours or experiences, you acknowledge and agree to the following:
1. Assumption of Risk
I understand that participating in walking tours, driving tours, boat excursions, and other sightseeing activities involves inherent risks, including but not limited to walking on uneven sidewalks, crossing streets, using public spaces, riding in motor vehicles or other forms of transportation, weather conditions, and other circumstances beyond the control of Boston Private Guide. I voluntarily assume these risks.
2. Release of Liability
To the fullest extent permitted by law, I release and hold harmless Boston Private Guide, its owners, employees, guides, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses arising from my participation in the tour, except where caused by gross negligence or willful misconduct.
3. Health and Fitness
I confirm that I am physically able to participate in the tour I have booked. I understand that it is my responsibility to inform Boston Private Guide of any medical conditions, mobility limitations, allergies, or other circumstances that may affect my participation before the tour.
4. Medical Emergencies
In the event of an illness or emergency, I authorize Boston Private Guide to seek appropriate medical assistance if necessary. I understand that any medical expenses incurred are my sole responsibility.
5. Personal Property
Boston Private Guide is not responsible for lost, stolen, or damaged personal belongings during the tour.
6. Transportation
When transportation is provided or arranged as part of the tour, I agree to follow all safety instructions, including wearing seat belts where available and complying with applicable laws and regulations.
7. Photography and Video
From time to time, Boston Private Guide may take photographs or video recordings during tours for promotional, educational, or marketing purposes. By participating, I acknowledge that I may appear incidentally in photographs or video that include other guests or public settings.
Whenever practical, we will request permission before taking close-up or individual photographs. If I prefer not to appear in photographs or videos used for promotional purposes, I will inform my guide at the beginning of the tour, and Boston Private Guide will make every reasonable effort to honor my request.
8. Force Majeure
Boston Private Guide shall not be responsible for cancellations, delays, or itinerary changes resulting from weather, traffic, government actions, public events, transportation disruptions, or other circumstances beyond its reasonable control.
9. Severability
If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Acknowledgment
By participating in a tour with Boston Private Guide, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Waiver and Release of Liability.
